Jaccard, Chairperson; and ) L.R. Barr, Deputy Chairperson ) December 12, 1996 CERTIFICATE OF PUBLIC CONVENIENCE AND NECESSITY WHEREAS: A. In letters dated October 25, 1996 and December 19, 1995 Treminco Resources Ltd. ("Treminco") requested Commission approval, pursuant to Sections 47 and 59 of the Utilities Commission Act (lithe Act"), to sell its electrical generating and distribution assets at Sandon, B.C. and discontinue operations as a public utility; and B. In letters dated October 21, 1996 and November 19, 1996 Silversmith Power and Light Corporation ("Silversmith") provided the Commission with information covering its incorporation, agreement to acquire all utility assets from Treminco, transfer of water licenses, operating budget and permits in order for it to receive approval to operate as a public utility; and C. The Commission has reviewed the documents and finds that the transactions require approval and are necessary and in the public interest. NOW THEREFORE the Commission orders as follows: 1. Pursuant to Section 47 of the Act, the Commission approves for Treminco its application for discontinuance as a public utility effective December 1, 1996. . . .12
2. Pursuant to Section 59 of the Act, the Commission approves for Treminco the sale of its electrical generating and distribution assets, effective December 1, 1996. 3. Pursuant to Sections 51 and 53 of the Act, Silversmith is granted a Certificate of Public Convenience and Necessity ("CPCN") for the provision of electrical service at Sandon, B.C., effective December 1, 1996. This CPCN is conditional on Silversmith continuing to obtain all other necessary approvals from other government agencies and filing them with the Commission.
