Jaccard, Chairperson; and K.L. Hall, Commissioner CERTIFICATE OF PUBLIC CONVENIENCE AND NECESSITY WHEREAS: A. Commission Order No. G-99-95, dated November 28, 1995, approved the terms of a Negotiated Settlement for the BC Gas Utility Ltd. ("BC Gas") 1996-98 Revenue Requirements Application. The Settlement terms provided that certain capital projects would require Certificate of Public Convenience and Necessity ("CPCN") applications; and B. On April 25, 1996, pursuant to Order No. G-99-95, BC Gas applied to the Commission for a CPCN in respect of three Lower Mainland Muster Station projects at Sardis, Richmond and Abbotsford; and C. The Commission, by Order No. C-7-96, granted a CPCN to BC Gas to proceed with its Sardis Muster Station Upgrade Project in accordance with the application; and D. On August 22, 1996, pursuant to Order No. G-99-95, BC Gas applied to the Commission for a CPCN for approval of its Richmond, B.C. Muster Station Site Replacement Project ("the Application"). In the Application BC Gas advised the Commission that it is presently negotiating with British Columbia Hydro and Power Authority ("B.C. Hydro") to lease a site adjacent to its Kidd Substation for the Muster Station; and E. The Commission has reviewed the costs, timing and justification contained in the Application and has determined that approval of the Application is necessary and in the public interest. u 1 ?~ /' C-10-96 ~S I . 2 NOW THEREFORE the Commission orders as follows: I. Pursuant to Section 51 of the Utilities Commission Act, a CPCN is granted to BC Gas to proceed with its Richmond Muster Station Site Replacement Project in accordance with the Application, subject to the receipt of reasonable written assurance from B.C. Hydro that the lease for the selected site will be continued for at least 10 years. 2. BC Gas is expected to complete the project within the costs detailed in the Application and is to file a variance review of final project costs with the Commission before applying for inclusion of the project costs in rates.
