By Order No.ÊG-46-94 dated June 22, 1994, the Commission approved for the Tahltan Nation Development Corporation ("TNDC"), exemption from certain provisions of the Utilities Commission Act ("the Act") in respect of the sale of power generated from its Hluey Lake hydroelectric generating facility at Dease Lake, B.C. to British Columbia Hydro and Power Authority ("B.C.ÊHydro"); and B. The Electricity Purchase Agreement for the project between TNDC and B.C.ÊHydro was approved by Commission Order No.ÊE-10-94; and C. On May 13, 1996 TNDC applied to the Commission for approval to transfer all of its rights and interests in the generating facility to a new company incorporated for that purpose and identified as the Stikine Nation Power Corporation ("SNPC"); and D. On June 5, 1995 B.C.ÊHydro provided to the Commission an AugustÊ9, 1995 Assignment and Consent Agreement by which all parties have agreed to assign the benefits of the Electricity Purchase Agreement and the Hluey Lake hydroelectric generating facility to SNPC; and E. The Commission has considered the Application and is satisfied that an Order approving the Assignment and transfer of rights is necessary and in the public interest. . . ./2
2 NOW THEREFORE the Commission orders the following: 1. The transfer of the rights and interests in the generating facility given by Orders No. G-46-94 and E-10-94 are approved to be transferred from TNDC to SNPC. 2. The Commission approves for B.C.ÊHydro the AugustÊ9, 1995 Assignment and Consent Agreement which transfers the benefits under the Electricity Purchase Agreement from TNDC to SNPC, effective immediately.
