Jaccard, Chairperson; and ) L.R. Barr, Deputy Chairperson ) May 3, 1996 CERTIFICATE OF PUBLIC CONVENIENCE AND NECESSITY WHEREAS: A. On April 25, 1996 BC Gas Utility Ltd. ("BC Gas ") applied to the Commission for approval of a Standard Form Franchise Agreement ("the Agreement") dated April 23, 1995 with the Corporation of the Village of Montrose ("the Village") pursuant to Section 51 of the Utilities Commission Act ("the Act"); and B. The Agreement replaces a 21-year Gas Franchise Agreement, approved by B.C. Energy Commission Order No. G-13-7 5 between Inland Natural Gas Co. Ltd. (a predecessor company to BC Gas ) and the Village, which expired April 21, 1996; and C. Municipal By-law No. 487, 1996 approved the Agreement and received approval in principle from the Minister of Municipal Affairs on February 23, 1996, pursuant to Section 646(2) of the Municipal Act; and D. The Commission has reviewed the Agreement and finds that approval is necessary and in the public interest. NOW THEREFORE pursuant to Section 51(4) of the Act, the Commission approves the April 23, 1995 Agreement between BC Gas and the Village covering the primary term from April 22, 1996 to April 21, 2006, and continuing from year-to-year thereafter, but not longer than 21 years.
