Jaccard, Chairperson; and ) L.R. Barr, Deputy Chairperson ) February 15, 1996 CERTIFICATE OF PUBLIC CONVENIENCE AND NECESSITY WHEREAS: A. On February 1, 1996 BC Gas Utility Ltd. ("BC Gas") applied to the Commission for approval of a Standard Form Operating Agreement ("the Agreement") dated November IS, 1995 with the Village of Belcarra ("the Village") pursuant to Section 51 of the Utilities Commission Act ("the Act"); and B. The Agreement initiates a gas operating agreement between BC Gas and the Village for an open-ended term that allows the utility to construct and operate an underground gas distribution system within village boundaries; and C. The Commission has reviewed the Agreement and finds that approval is necessary and in the public interest. NOW THEREFORE pursuant to Section 51(4) of the Act, the Commission approves the November 15, 1995 Standard Form Operating Agreement between BC Gas and the Village, for an open-ended term, provided that such determination, approval and grant shall not restrict any regulatory power of the Commission.
