On DecemberÊ16, 1997, Trans Mountain Enterprises of British Columbia Limited ("TME") applied to the Commission, pursuant to SectionÊ44 of the Pipeline Act ("the Act"), for approval of interim tolls effective JanuaryÊ1, 1998 ("theÊApplication"). The Application includes a proposed incentive toll agreement on the Jet Fuel Pipeline covering a five-year period commencing on JanuaryÊ1, 1998 to DecemberÊ31, 2002; and B. The Shippers have provided agreement in principle to the incentive tolls and TME expects that the final incentive toll agreement will be filed for approval by January 30, 1998; and C. The Application for interim tolls effective January 1, 1998 includes the 1998 revenue requirements that have been accepted by the Shippers and the forecasted 1998 throughput; and D. The Commission has reviewed the Application and finds that approval of interim tolls on the Jet Fuel Pipeline is required. NOW THEREFORE the Commission orders as follows: 1. The Commission approves for TME, the Application for interim tolls on its Jet Fuel Pipeline that allows for a gathering toll of $0.697/M 3 and a mainline toll of $1.686/M 3 , effective JanuaryÊ1, 1998 subject to TME filing a final incentive toll agreement with its Shippers by JanuaryÊ30, 1998. 2. TME is to provide all Shippers on the Jet Fuel Pipeline with a copy of this Order and approved interim tolls effective JanuaryÊ1, 1998.
