Jaccard, Chairperson; and ) L.R. Barr, Deputy Chairperson ) June 7, 1996 ORDER WHEREAS: A. In 1994 B.C. Hydro sought Leave to Appeal the Commission's directions and jurisdiction of its Integrated Resource Plan ("IRP") Guidelines including the IRP aspects contained in Commission Decision and Order No. G-89-94; and B. On November 6, 1995 British Columbia Hydro and Power Authority ("B.C. Hydro") filed its final 1995 IRP with the Commission; and C. On December 15, 1995 the Commission, by Order No. G-l1 0-95, set the matter down for public hearing and issued a Regulatory Timetable. The Regulatory Timetable was subsequently amended by Order No. G-6-96 with the public hearing set to commence February 26, 1996; and D. On February 23, 1996 the B.C. Court of Appeal found that the Commission had exceeded its statutory powers of the IRP Guidelines for B.C. Hydro and the IRP directions were therefore unenforceable. The Commission, by Letter No. L-9-96, advised participants that the B.C. Hydro IRP public hearing would not proceed; and E. On May 15, 1996 the Independent Power Association of British Columbia ("IPABC") applied to the Commission for participant funding to recover costs expended in preparing for the B.C. Hydro IRP hearing which did not proceed; and ... 12
F. The Commission has reviewed the IPABC application submitted against the criteria set out in Order No. G-117-93. NOW THEREFORE the Commission orders that pursuant to Section 133.1(2) of the Utilities Commission Act, the Commission awards funds to IPABC in the total amount of $6,801.88.
