Jaccard, Chairperson; and ) L.R. Barr, Deputy Chairperson ) January 25, 19 96 ORDER WHEREAS: A. On December 15, 1995 Trans Mountain Enterprises of British Columbia Limited ("TME") applied to the Commission for approval of a 5% increase in its tolls on the Jet Fuel Pipeline effective February 1, 1996 ("the Application"), pursuant to Section 44 of the Pipeline Act ("the Act"); and B. The Application included an increase to depreciation expense resulting from a 1995 depreciation study conducted for TME and its parent company, Trans Mountain Pipe Line Company Ltd. ("TMPL"); and C On January 22, 1996 the Vancouver Airport Fuel Facilities Corporation and Canadian Airlines Limited ("the Airlines") complained about TME's Application and raised specific concerns about the proposed toll increase and the depreciation study; and D. The Commission has reviewed the Application and the Airlines' complaint and finds that a decision on TME's tolls is required. NOW THEREFORE the Commission orders as follows: 1. The Commission, pursuant to the Act, orders the current tolls on the TME Jet Fuel Pipeline, to be interim, effective February I, 1996, pending resolution of the Airlines' complaint. 2. TME is to provide the Commission and the Airlines with a response to the January 22, 1996 Airlines' complaint, except for the depreciation study, by February 16, 1996. . . .12
3. The Airlines are required to provide the Commission and TME with any reply to the TME response by March 1, 1996. 4. Following the Airlines' reply, TME is to provide any response by March 8, 1996. The Commission will then make a decision on the tolls based on the information filed by all parties. 5. The Commission advises that any rate changes resulting from the depreciation study and further comment from TME and the Airlines regarding the depreciation study and changes to 1996 depreciation expense, will be deferred until the National Energy Board's Decision on TMPL's 1996 toll application has been rendered, along with the impact on tolls for the TME Jet Fuel Pipeline.
