Barr, Deputy Chairperson ) and Acting Chair; and ) April 17, 1997 K.L. Hall, Commissioner ) O R D E R WHEREAS: A. By way of letter dated November 27, 1996, West Kootenay Power Ltd. ("WKP") filed a Transmission Access Application (Òthe ApplicationÓ) for approval with the Commission; and B. Contained in the Application was a statement indicating WKP's intention to file a rate design application in early to mid 1997; and C. By way of Commission Order No. G-6-97, dated January 24, 1997, the Commission set down a public hearing into the matter of Retail Access and Unbundled Tariffs to commence April 1, 1997; and D. By way of letter dated March 26, 1997 the Minister of Employment and Investment ('the Minister") requested that the said public hearing be deferred, having regard to the appointment of a Task Force to report on electricity market reform; and E. By way of Commission Order No. G-34-97, the Commission asked Registered Intervenors to the scheduled Retail Access and Unbundled Tariffs Hearing to comment on the Minister's request and the appropriate disposition of the WKP's Transmission Access Application by April 11, 1997; and .../2

The Commission received submissions from numerous parties some of whom indicated that it would be more appropriate to delay disposing of the WKP Application until after the report of the Task Force; and G. WKP indicated that it was willing to proceed with a revised transmission application relating solely to wholesale transmission but indicated that delaying the disposition of the application would permit it to proceed with its Rate Design Application as planned; and H. By way of Commission Order No. G-41-97 the scheduled hearing into Retail Access and Unbundled Tariffs was indefinitely deferred. NOW THEREFORE the Commission orders as follows: 1. WKP is directed to file its Rate Design Application contemplated in the Transmission Access Application no later than July 15, 1997. 2. The WKP Transmission Access Application will be held in abeyance until after the report of the Task Force or until such other time as the Commission decides.
