On JanuaryÊ30, 1997 the Commission by Order No.ÊG-9-97 approved an application by AEC West Ltd.Ê(ÒAECÓ) for an exemption from certain sections of the Utilities Commission ActÊ(ÒtheÊActÓ) covering the sale of power by AEC from its Sechelt Creek Hydroelectric project to British Columbia Hydro and Power AuthorityÊ(ÒB.C.ÊHydroÓ) pursuant to the authority given by Ministerial Order No.Ê1-M-51; and B. On JanuaryÊ31, 1997 B.C.ÊHydro approved the assignment of rights contained in the AugustÊ31, 1990 Electricity Purchase AgreementÊ(ÒEPAÓ) with AEC, to Regional Power Inc.Ê(ÒRegionalÓ) effective DecemberÊ1, 1996, pursuant to SectionÊ13.1 of the EPA; and C. On FebruaryÊ10, 1997 Regional applied to the Commission for approval of an exemption from the Act covering the sale of power to B.C.ÊHydro; and D. The Commission has considered the application and is satisfied that an order approving the Assignment and transfer of rights is necessary and in the public interest. NOW THEREFORE the Commission orders that the sale of power by Regional to B.C.ÊHydro is exempt from the Act, other than PartÊ2 and SectionÊ114, pursuant to the authority given by Ministerial Order No.Ê1-M-51, attached as AppendixÊA.
