Propane Grid System to serve the Sun Peaks Resort Area BEFORE: P. Ostergaard, Chair ) L.R. Barr, Deputy Chair ) June 25, 1998 CERTIFICATE OF PUBLIC CONVENIENCE AND NECESSITY WHEREAS: A. On January 30, 1998, Sun Peaks Utilities Co., Ltd. (ÒSPUCLÓ), a wholly owned subsidiary of Sun Peaks Resort Corporation, applied to the Commission, pursuant to Sections 45 and 46 of the Utilities Commission Act (Òthe ActÓ), for approval to construct and operate an underground propane grid distribution system and to operate a propane storage and vaporization plant to service the resort community at Sun Peaks and the surrounding area at Tod Mountain northeast of Kamloops, B.C.; and B. In its application SPUCL states that it has contracted with DESCO Distributed Energy Services Co. Ltd., a subsidiary of BC Gas Inc., to provide propane vapor distribution technical services, propane supply, and propane storage and vaporization facilities; and C. In its application SPUCL indicates that a propane vapor system will provide the necessary energy supply for the growing resort community, will reduce energy costs to users, will maintain air quality, and will permit conversion of the distribution system to natural gas at some future time; and D. In its application SPUCL states that it has obtained, or will obtain, all other licenses, permits and agency approvals necessary for constructing and operating the propane grid system; and E. On March 31, 1998, SPUCL provided additional information in support of its application, including confirmation that its propane plant and distribution system have been inspected and approved by the Gas Safety Branch and the Boiler and Pressure Vessel Branch of the Ministry of Municipal Affairs; and F. The Commission has considered the application and supporting documentation and finds that approval of a Certificate of Public Convenience and Necessity (ÒCPCNÓ) for the construction and operation of the underground propane grid distribution system and the operation of the propane storage and vaporization plant is necessary and in the public interest. NOW THEREFORE the Commission, pursuant to Section 45 of the Act, orders as follows: 1. SPUCL is granted a CPCN to serve the Sun Peaks resort community and the surrounding area by way of an underground propane grid distribution system, including related propane storage and vaporizer equipment. The service area is generally described by the outlined areas shown on the map that is attached as Appendix A to this Order, and which is identified as Sun Peaks Resort, Municipal Address System. .../2
2 2. SPUCL is to file with the Commission for approval, its Gas Tariff Ð Terms and Conditions and Rates in a form suitable to the Commission, as soon as possible. The Rates and Terms and Conditions of Service are to include detailed calculations in support of such schedules. 3. SPUCL is directed to provide the Commission with an Annual Report which sets out the system facilities installed during the year, the capital cost of these works and the customers that were added during the year. The report should also provide a forecast of these matters for the subsequent year, and should be filed within 90 days of SPUCLÕs fiscal year end. That is, a report on activities in 1998 and a forecast for 1999 is due by March 1, 1999. The reporting format for all filings required by this Order is to be established in consultation with Commission staff.
