On February 5, 1998, Alberta Power Limited ("APL") applied for approval to construct and operate a 25 kV, 17.3 km transmission line from its Hamburg Substation in Alberta to the Pioneer Natural Resources Canada Inc. ("Pioneer") Chinchaga Gas Plant, 140 km north of Fort St. John, B.C.; and B. APL has applied for and received the necessary approvals from the Ministry of Environment, Lands and Parks, and the Electrical Safety Branch of the Ministry of Municipal Affairs to permit the construction of the 25 kV transmission line, 1.5 km of which is in British Columbia; and C. APL has applied for an exemption from certain sections of the Utilities Commission Act to which the Commission is requesting the approval of the Lieutenant Governor in Council to issue an Order approving the exemption; and D. On March 26, 1998, British Columbia Hydro and Power Authority advised the Commission that it supported the APL application to serve Pioneer; and E. On April 1, 1998, the Commission approved the Electric Service Agreement between APL and Pioneer and issued Order No. E-4-98; and F. The Commission has reviewed the application and finds that a Certificate of Public Convenience and Necessity is required to be issued. .../2
2 NOW THEREFORE the Commission orders as follows: 1. Pursuant to Section 45 of the Utilities Commission Act, the Commission approves for APL the issuance of a Certificate of Public Convenience and Necessity to construct and operate the 17.3 km, 25 kV transmission line from the Hamburg Substation in Alberta to Pioneer's Chinchaga Gas Plant. 2. The CPCN is issued subject to APL obtaining all required permits, licences and agency approvals necessary for constructing and operating the 25 kV transmission line to serve Pioneer's Chinchaga Gas Plant.
