Ostergaard, Chair ) L.R. Barr, Deputy Chair ) May 6, 1998 O R D E R WHEREAS: A. On March 9, 1998, West Kootenay Power Ltd. ("WKP") filed a Transmission Access Application (Òthe ApplicationÓ) seeking approval of wholesale transmission access and retail transmission access for its Industrial and Municipal customers; and B. In its Application WKP requested interim approval of Tariff Supplement No.Ê7 (Terms and Conditions) and of rates as set out in Rate Schedules 100 to 108 for use by eligible customers seeking wholesale transmission access as defined in Tariff Supplement No.Ê7 (Eligible Customers), excluding customers served under Rate Schedule 31, as of MarchÊ21, 1998. WKP requested that the Commission direct that a Consultative Committee be established with a mandate as set out in Tab 10 of the Application as of the date of the interim approval; and C. The Commission, by Order No.ÊG-29-98, granted interim approval of Tariff Supplement No.Ê7 and of rates set out in Rate Schedules 100 to 108 for use by customers seeking wholesale transmission access, effective March 21, 1998. The Commission established and subsequently held a pre-hearing conference on Friday, April 17, 1998 that was video-conferenced between Vancouver and Trail, B.C.; and D. As a result of input from the April 17, 1998 pre-hearing conference the Commission has agreed to issue a Regulatory Timetable to review the Application. . . . /2
2 NOW THEREFORE the Commission orders as follows: 1. WKP is ordered to refile, by JulyÊ31, 1998, its Transmission Access Application with any changes it considers appropriate after reviewing the CommissionÕs AprilÊ23, 1998 Decision on British Columbia Hydro and Power AuthorityÕs Wholesale Transmission Services Application. 2. A Regulatory Timetable into the WKP Transmission Access Application is established and attached as AppendixÊA to this Order. 3. The times and locations of the SeptemberÊ10, 1998 Workshop and the OctoberÊ19, 1998 Public Hearing will be issued by way of a future Commission Order and will be sent out to registered intervenors, following the July 31, 1998 refiling of WKPÕs 1998 Transmission Access Application.
