On April 16, 1999, the Commission issued Order No. G-41-99 approving a waiver, for 1999 only, of a provision in the Special Conditions contained in the British Columbia Hydro and Power Authority (“B.C. Hydro”) Rate Schedule 1848. The waiver states that a customer who terminates Real Time Pricing (“RTP”) service will be subject to a waiting period of one year from the date of termination before the customer can reapply for service; and B. The Order also approved the specifics of the proposal, as set out in B.C. Hydro’s Letter dated March 18, 1999, and approved the waiver under the same terms and conditions for other RTP related schedules; and C. On April 29, 1999, B.C. Hydro wrote to the Commission explaining its proposed implementation of Order No. G-41-99; and D. Commission Staff spoke with B.C. Hydro staff to clarify certain aspects of the proposal; and E. As part of the implementation proposal B.C. Hydro stated that it would seek from all previous RTP customers confirmation that there has been no material change in the customer’s operations that would affect its Customer Baseline Load (“CBL”); and F. B.C. Hydro will calculate the difference between what the customer would have paid under Rate Schedule 1848 and what it did pay under Rate Schedule 1821 for the period commencing the day the customer left the program and ending at the end of the March 1999 billing period (“the Billing Adjustment”), including any applicable taxes but excluding interest owing to either party; and G. B.C. Hydro will calculate separately an amount for April 1999 which reflects the difference between what the customer would have been billed for service under Rate Schedule 1848 and what it was billed under Rate Schedule 1821 (“the April 1999 Adjustment”); and H. The RTP price used to calculate the Billing Adjustment and the April 1999 Adjustment will be the RTP daily index price the customer elected immediately prior to the date it left the RTP program; and . . ./2

Hydro will provide the customer with an Agreement which contains the Billing Adjustment, which states that there will be a further April 1999 Adjustment, and which contains a provision stating that the customer agrees that the amounts of the Billing Adjustment and the April 1999 Adjustment are final and will not be readjusted; and J. After receipt of the Agreement a customer will have two weeks to determine whether they wish to elect to return to the RTP program and to notify B.C. Hydro; and K. Customers seeking CBL reductions can elect to return to the program subject to receiving Commission approval of their reduced CBL; and L. For those customers seeking CBL reductions, B.C. Hydro will make applications to the Commission; and M. The Commission has reviewed the proposal from B.C. Hydro to ensure that it is in accord with the waiver approved by Commission Order No. G-41-99. NOW THEREFORE the Commission orders as follows: 1. The implementation proposal as set out in this Order is approved. 2. B.C. Hydro will recalculate the Billing Adjustment and April 1999 Adjustment for those Customers who unsuccessfully sought approval of a CBL reduction from the Commission. These customers will have two weeks from the time this information is provided to them to elect to return to the RTP program and to notify B.C. Hydro.
