(“BC Gas”) applied to the Commission for approval to continue interruptible deliveries at the $0.25/GJ rate, set out in the Interruptible Transportation Service Agreement with British Columbia Hydro and Power Authority (“B.C. Hydro”), from September 30, 1998 to January 1, 1999; and B. The existing agreement, identified as the “Amended and Restated Burrard Thermal Interruptible Gas Purchase Agreement”, dated September 29, 1988, was approved by Order No. G-101-95 with an effective date of September 1, 1995, and which expired at 8:00 a.m., on September 30, 1998; and C. BC Gas and B.C. Hydro have agreed to an extension of the existing transportation rate of $0.25/GJ. BC Gas has requested that the rate be made interim subject to the new provisions of a negotiated bypass agreement for the Burrard Thermal Plant which will automatically supercede the interim rate; and D. The Commission has reviewed the filing and finds that the rate should be approved. NOW THEREFORE the Commission orders as follows: 1. The Commission approves for BC Gas an interim interruptible transportation rate of $0.25/GJ for deliveries to B.C. Hydro’s Burrard Thermal Generating Station for the period 8:00 a.m. PST, . . ./2
2 September 30, 1998 to 8:00 a.m. PST, January 1, 1999, subject to the timely filing of the service agreement in standard Tariff Supplement format, and with the revenue credited as set out in BC Gas’ October 6, 1998 application. 2. The Commission denies BC Gas’ request that the provisions of a “bypass” agreement, which may result from its negotiations with B.C. Hydro, will automatically supercede the interim rate.
