On May 21, 1999, Central Heat Distribution Limited (“CHDL”) applied to the Commission for approval of the proposed Terms and Conditions of a Permanent Operating Agreement (“the Agreement”) with the City of Vancouver (“the City”) pursuant to Section 32 of the Utilities Commission Act (“the Application”); and B. The proposed Agreement replaces a thirty-year Franchise Agreement between CHDL and the City that expired on June 29, 1996 and, by agreement with the City, was subsequently extended on an interim basis; and C. On July 15, 1999, the Commission by Order No. G-77-99, established a regulatory timetable for negotiations on August 26 and 27, 1999 and for a public hearing to commence on September 28, 1999 if negotiations are unsuccessful; and D. On August 17, 1999 CHDL and the City requested that the regulatory timetable in Order No. G-77-99 for information requests, information responses and negotiations be adjourned; and E. On August 19, 1999 CHDL, the City and Commission staff established a revised regulatory timetable that allowed negotiations between CHDL and the City to continue until September 3, 1999 and, if a public hearing is required on September 28, 1999, set dates for information requests and responses; and …/2
2 F. The Commission has reviewed the August 17, 1999 request by CHDL and the City and finds that the regulatory timetable established by Order No. G-77-99 requires amendment. NOW THEREFORE the Commission orders as follows: 1. The Commission establishes the following amended regulatory timetable to deal with the Application. AMENDED REGULATORY TIMETABLE Action CHDL and the City report on status of negotiations and issue information requests Respond to all Information Requests Additional Evidence filed Information Requests on additional filed Evidence issued by all Parties City submissions on BCUC jurisdiction CHDL submissions on BCUC jurisdiction Information Responses on Additional Evidence Public Hearing commences 2. If either party wishes Commission staff assistance with the negotiations, then the party should contact Commission staff prior to September 3, 1999. 3. The Public Hearing is scheduled to commence at 9:00 a.m. in the Commission’s Hearing Room, 6 th Floor, 900 Howe Street, Vancouver, B.C. 4. The Preliminary Issues List attached as Appendix A to Order No. G-77-99 is to be addressed at the negotiations and Public Hearing.
