On June 8, 1999, Kanelk Transmission Company Limited (“Kanelk”) applied to the Commission pursuant to Sections 52 and 41 of the Utilities Commission Act (“the Act”), to dispose of its utility property in British Columbia and assign the associated Certificate of Public Convenience and Necessity to British Columbia Hydro and Power Authority (“B.C. Hydro”) (“the Application”); and B. Kanelk’s facilities in British Columbia were built in 1951 and run from TransAlta Utilities Corporation’s southern Alberta transmission system at Pocaterra, Alberta to B.C. Hydro’s Natal Substation. The line then runs east from the substation and terminates at Coleman, Alberta. The line is presently used by B.C. Hydro to serve its customers in the Elk Valley; and C. Kanelk and B.C. Hydro signed an agreement, dated December 15, 1998, for the sale of the utility assets for the amount of $4,323,000 subject to Commission approval; and D. The District of Elkford, the Regional District of East Kootenay and Fording Coal Ltd. have expressed their interest and concerns about the sale of Kanelk’s utility assets; and E. The Commission has reviewed the Application and finds that a public process and a Pre-hearing Conference is required. . . ./2
2 NOW THEREFORE the Commission orders as follows: 1. The Commission will hold a Pre-hearing Conference on the Application on July 22, 1999 at 7:00 p.m. local time, at the Recreation Centre, in Elkford, B.C. The Pre-hearing Conference will address all aspects of the Application, identify the principal issues and examine what further process is required. 2. Kanelk is to arrange for publication of the Notice of Pre-hearing Conference, attached as Appendix A, in all local newspapers of the service area, including those in Cranbrook, B.C., by July 9, 1999. THE APPLICATION On June 8, 1999 Kanelk Transmission Company Limited (“Kanelk”) applied to the Commission to dispose of its utility assets consisting of a 120 km, 138 kV transmission line located in the Elk Valley to British Columbia Hydro and Power Authority (“B.C. Hydro”) for $4,323,000. The transmission line serves B.C. Hydro’s customers located in the Elk River Valley, the District of Elkford, and the coal mines of Fording Coal, Greenhills Coal and Line Creek Coal Mines. THE REGULATORY PROCESS The Commission will hold a Pre-hearing Conference in Elkford on July 22, 1999 to discuss procedural matters which will include, but not be limited to, the following: • future processes, • completeness of the Application, • identification of principal issues, • other matters that will enable the proceeding to efficiently cover and review all aspects of the Application.
