Transit BEFORE: P. Ostergaard, Chair ) L.R. Barr, Deputy Chair ) June 30, 1999 B.L. Clemenhagen, Commissioner ) O R D E R WHEREAS: A. BC Gas Utility Ltd. (“BC Gas”) provides service to British Columbia Transit (“B.C. Transit”) at its Port Coquitlam Transit Centre under a Compression/Dispensing Service Agreement dated May 30, 1991 that was approved by Order No. G-69-91 as Tariff Supplement No. 19, and a Firm Gas Service Agreement dated November 27, 1991; and B. In 1994 the Commission, by Order No. G-44-94, approved for BC Gas an Incentive Grant Agreement with B.C. Transit that provided for a grant of $1,250,000 to assist in the purchase of 25 Natural Gas Vehicles (“NGV”) buses; and C. On March 15, 1999, BC Gas applied to the Commission for approval to replace the earlier NGV Agreements with B.C. Transit, with B.C. Transit to repay $970,000 of the incentive grant; and D. The Commission has reviewed the application and finds that the new Agreements should be approved. NOW THEREFORE the Commission orders as follows: 1. The Commission approves for BC Gas the following Agreements with B.C. Transit for service to its Port Coquitlam Transit Centre: Substitution and Novation Agreement for the Supply of Natural Gas Compression Services and the Supply and Delivery of Natural Gas with B.C. Transit, dated December 1, 1998. . . ./2
2 Annex A Natural Gas Compression and Dispensing Service Agreement with B.C. Transit dated December 1, 1998. Annex B Rate Schedule 6 Natural Gas Service Agreement dated December 1, 1998. 2. The Commission approves the cancellation of Tariff Supplement No. 19 for NGV service to B.C. Transit. 3. BC Gas is to file with the Commission fully executed copies of the above-noted Agreements in standard Tariff Supplement format. 4. The compensation to be paid by B.C. Transit for the cancellation of earlier Agreements, should be applied against the undepreciated balance in the B.C. Transit incentive grant account. The Commission will determine the disposition of the residual credit amount at a future date.
