Supply and Peaking Agreements with Dynegy Canada Marketing and Trade BEFORE: P. Ostergaard, Chair ) L.R. Barr, Deputy Chair ) July 22, 1999 O R D E R WHEREAS: A. On July 15, 1999, Pacific Northern Gas Ltd. (“PNG”) filed with the Commission a Letter Agreement for natural gas seasonal and peaking contracts with Dynegy Canada Marketing and Trade (“Dynegy”), a division of Dynegy Canada Gas Marketing Ltd.; and B. The Agreement with Dynegy will provide PNG with the seasonal contracts for 2,500 GJ/d of five months seasonal supply for the period November 1, 1999 through to March 31, 2000 and 5,000 GJ/d of three months supply for the period December 1, 1999 through February 29, 2000; and C. The Agreement with Dynegy will also provide PNG with up to 15,000 GJ/d of peaking gas at Station 2 from December 1, 1999 to February 29, 2000; and D. The Commission has reviewed the filing and finds that the seasonal contracts for a 2,500 GJ/d block of five months seasonal supply for the period November 1, 1999 through to March 31, 2000 and the 5,000 GJ/d of three months supply contracts for the period December 1, 1999 through February 29, 2000 with Dynegy is appropriate; and E. The Commission also finds that the peaking contract of zero to 15,000 GJ/d for the period from December 1, 1999 to February 29, 2000 with Dynegy is appropriate; and . . . /2
2 NOW THEREFORE pursuant to Section 71 of the Act and the Rules for Energy Supply Contracts, the Commission accepts for filing for PNG, the July 15, 1999 Letter Agreement with Dynegy for seasonal and peaking gas. This acceptance is subject to the timely filing of the fully executed contract. The Commission will hold the pricing and terms and conditions of the contract confidential.
