(“WKP”) applied to the Commission for a Certificate of Public Convenience and Necessity (“CPCN”) for its Kootenay 230 kV System Development project (“the Kootenay 230 kV Project”) pursuant to Section 45(1) of the Utilities Commission Act (“the Act”); and B. The Kootenay 230 kV Project application was preceded by a review of WKP’s 20-Year System Plan filing that was discussed by participants at a workshop in Penticton on May 27, 1999. On June 15, 1999, the Commission issued Letter No. L-28-99 directing the Utility to file applications for CPCNs where required and in accordance with WKP’s priority and scheduling needs; and C. The Kootenay 230 kV Project is intended to improve reliability by upgrading and expanding the WKP transmission system in the Kootenay Region; and D. The Commission has reviewed the Kootenay 230 kV Project application and finds that a public hearing process is required to be established. NOW THEREFORE the Commission orders as follows: 1. A Regulatory Agenda and Timetable into WKP’s Kootenay 230 kV Project is attached as Appendix A to this Order.

A public hearing into the Kootenay 230 kV Project is scheduled to commence at 9:00 a.m. on Monday, February 21, 2000 at the Best Western Fireside Inn in Castlegar, B.C. 3. A Workshop and Pre-hearing Conference will take place on Friday, January 14, 2000 at 9:00 a.m. at the Best Western Fireside Inn in Castlegar, B.C. 4. A Notice of Public Hearing, Workshop and Pre-hearing Conference is attached as Appendix B to this Order. WKP is required to publish the Notice, as soon as possible, in local newspapers in the affected service areas, in order to adequately notify its customers. A copy of this Order, Appendix A and Appendix B is required to be sent by WKP to Intervenors and Interested Parties who registered for the workshop on the 20-Year System Plan and the WKP Negotiated Settlement Process for the 2000-2002 Revenue Requirements. 5. WKP is to distribute copies of the Application and Appendices, and any supplemental and/or supporting information, to Registered Intervenors. A copy of this Order will be sent by the Commission to all parties registering with the Commission. 6. Registered Intervenors and Interested Parties intending to make requests for additional information, or participate in the Workshop, Pre-hearing Conference or Public Hearing, are to follow the Regulatory Agenda and Timetable set out in Appendix A to this Order. 7. All parties intending to apply for Participant Assistance must file a budget by Monday, January 31, 2000. The budget must be consistent with the Commission’s Participant Assistance/Cost Award Guidelines as outlined in Order No. G-97-98. (“WKP”) has applied to the Commission for a Certificate of Public Convenience and Necessity (“CPCN”) to build and operate the Kootenay 230 kV System Development project (“the Kootenay 230 kV Project”), for the purpose of upgrading and expanding WKP’s transmission system in the South Slocan, Castlegar, Trail and Waneta areas. The Kootenay 230 kV Project proposes to upgrade the present Kootenay transmission system with 230 kV lines and switchyards, replacing the present 63 kV lines between South Slocan and Trail, and adding a 230 kV line between Trail and the Waneta generating station. Registered Intervenors who actively participate in the proceeding will receive copies of the Kootenay 230 kV Project Application, the Appendices, all correspondence and filed documentation. Interested Parties who register with the Commission and who do not expect to be active participants will receive from the Commission a copy of the Application, all Orders issued, and the Commission’s Decision. INFORMATION REQUESTS Registered Intervenors requesting additional information from WKP on the Kootenay 230 kV Project should do so no later than Friday, January 21, 2000. WKP is required to respond to information requests no later than Friday, February 4, 2000.
