Ostergaard, Chair ) L.R. Barr, Deputy Chair ) P.G. Bradley, Commissioner ) March 9, 2000 B.L. Clemenhagen, Commissioner ) K.L. Hall, Commissioner ) O R D E R WHEREAS: A. On February 22, 2000, Port Alice Gas Inc. (“Port Alice”) filed with the Commission an Agreement with Autogas Propane Ltd. (“Autogas”) for the estimated supply of 845 m 3 of propane for the community of Port Alice, B.C.; and B. The Agreement is for the initial period of April 1, 2000 to March 31, 2001, with yearly renewals until March 31, 2005, unless terminated earlier by either party. The estimated annual demand over the period 2000 to 2005 is 845 m 3 /year; and C. The product price is determined as the average domestic value of Amoco (Gibson terminal), Gulf and Shell for propane posted at Edmonton, Alberta at the beginning of each month; and D. Each year the parties have 90 days before the March 31 date to negotiate a freight factor at which time the contract automatically rolls over. Should the parties fail to agree on a freight factor the Agreement terminates; and E. The Commission has considered the Agreement between Port Alice and Autogas and is satisfied that it should be accepted for filing. NOW THEREFORE pursuant to Section 71 of the Utilities Commission Act and the Rules, the Commission accepts for filing the April 1, 2000 Agreement between Port Alice and Autogas for the supply of propane for the 2000/2001 gas contract year.
