Leighton, Commissioner ) O R D E R WHEREAS: A. The Commission, by Order No. P-5-95, approved the incentive tolling methodology for Federated Pipe Lines (Western) Ltd.’s (“Federated”) Taylor to Kamloops Crude Oil Pipeline covering the period January 1, 1995 to December 31, 1999. The methodology involved a sharing of throughput variances between Federated and its shippers and allowed annual toll revisions to take place on January 1 st of each year under an automatic formula, subject to review by the Commission in the event of a complaint; and B. On March 13, 2000, Federated applied to the Commission for approval to set tolls for 2000 based on a one-year continuation of the 1995-1999 incentive tolling methodology; and C. On March 1, 2000, Federated held a shippers’ meeting and subsequently no complaints were received by Federated or the Commission on the proposed 2000 tolls and continuation of the incentive tolling methodology; and D. The Commission has reviewed the application and finds that approval of the 2000 tolls for the Taylor to Kamloops Crude Oil Pipeline is required. …/2
2 NOW THEREFORE the Commission orders as follows: 1. Pursuant to Section 44 of the Pipeline Act, the Commission approves Federated’s application to increase tolls on its Taylor to Kamloops Pipeline from $3.61 to $4.16/m $5.56 to $6.40/m 3 for deliveries to Kamloops, and Tariff No. 28, effective January 1, 2000, subject to review in the event of a complaint. 2. The Commission approves for Federated, a one-year extension to December 31, 2000 to the 1995 to 1999 incentive tolling methodology approved by Order No. P-5-95. 3. Federated is to provide all shippers on the Crude Oil Pipeline with a copy of this Order and the approved Tariff No. 28.
