Nicholls, Commissioner ) CERTIFICATE OF PUBLIC CONVENIENCE AND NECESSITY WHEREAS: A. On February 16, 2000, West Kootenay Power Ltd. (“WKP”) applied to the Commission for a Certificate of Public Convenience and Necessity (“CPCN”) for approval to upgrade its Penticton 63 kV Subtransmission System; and B. On March 7, 2000, Commission staff issued Information Request No. 1 to WKP asking for a response to questions arising from the Application. WKP advised the Commission that it would be refiling the Penticton CPCN Application and that a review of it need not proceed at that time; and C. On September 15, 2000, WKP refiled the Application for a CPCN to Upgrade the Penticton Subtransmission System (“the Application”); and D. On September 29, 2000, Commission staff issued an information request concerning the Application to which WKP responded on October 23, 2000; and E. WKP advised the Commission that the City of Penticton and the Penticton Indian Band had been consulted and were aware of the project; and F. The Commission has reviewed the costs, timing and justification of the project and finds that it should be approved. NOW THEREFORE the Commission orders as follows: 1. The Commission approves, pursuant to Section 45 of the Utilities Commission Act, the issuance of a CPCN to WKP to proceed with the Upgrade to the Penticton Subtransmission System estimated to cost $2,426,001. .../2

The impact of this project on Power Purchase expenses should be dealt with separately in the review of Power Purchase forecasts and therefore, WKPs request to capitalize the additional power purchase expenses caused by the de-rating of Line No. 11 is denied. 3. WKP is to provide the Commission with monthly progress reports and a final project cost report within six months of its completion.
