Nicholls, Commissioner ) O R D E R WHEREAS: A. Commission Order No. G-44-96, dated May 10, 1996, approved amendments to Rate Schedule 30-Off-System Interruptible Sales Rate Schedule and Agreement (B.C. Sales); and B. On October 30, 2000, BC Gas Utility Ltd. (“BC Gas”) requested approval of a Gas Purchase and Sale Agreement with PG&E Energy Trading, Canada Corporation (“PG&E”) dated October 1, 2000 (the “PG&E Agreement”) as a Rate Schedule 30 Tariff Supplement; and C. The PG&E Agreement language relating to failure to deliver or receive gas and several other matters has been changed from that in Rate Schedule 30, so as to reflect the provisions of current contracts governing gas purchase and sales transactions; and D. The Commission has reviewed BC Gas’ Application and the PG&E Agreement enclosed with it. NOW THEREFORE pursuant to Section 61 of the Utilities Commission Act, the Commission orders as follows: 1. The PG&E Agreement is approved as a Rate Schedule 30 Tariff Supplement, subject to BC Gas filing the PG&E Agreement as a public document in standard Tariff Supplement format with the Commission. 2. BC Gas is directed to file the PG&E Agreement in Tariff Supplement format by December 4, 2000. . . ./2

In the event that BC Gas, pursuant to the PG&E Agreement, enters into contracts to purchase gas, BC Gas will file such contracts with the Commission pursuant to Section 71 of the Utilities Commission Act and the Rules for Energy Supply Contracts.
