On July 20, 2001, British Columbia Hydro and Power Authority (“B.C. Hydro”) applied to the Commission for a Certificate of Public Convenience and Necessity to operate the Fort Nelson Electrical Generating Project (“Fort Nelson Plant”); and B. B.C. Hydro is required to purchase the Fort Nelson Plant pursuant to the terms and conditions of agreements entered into with TransAlta Energy Corporation (“TransAlta”) at the time of construction of the Fort Nelson Plant; and C. The reliability of supply to Fort Nelson customers is dependent on the operation of the Fort Nelson Plant and the net financial benefit to B.C. Hydro from the operation of the Fort Nelson Plant has been approximately $30 million dollars over the past 24-month period; and D. The Commission has reviewed the application and finds that it is necessary and in the public interest for B.C. Hydro to operate the Fort Nelson Plant in order to provide reliable supply to customers in Fort Nelson. NOW THEREFORE pursuant to Section 45 of the Act, a Certificate of Public Convenience and Necessity is issued to B.C. Hydro for the operation of the Fort Nelson Electrical Generating Project.
