L-31-01 and Commission Reasons for Decision regarding the Complaint - Routing of 230 kV Transmission Lines through Ootischenia Area This is in response to your letter of October 30, 2001 (received via e-mail). The following reply corresponds to your numbered paragraphs. 1. The Commission is not in the practice of appending such information to Decisions. Information on how to challenge a decision is available on the Commission’s web site or can be requested by telephone. We note that you have been previously provided with a copy of the Participants Guide to the British Columbia Utilities Commission, which contains instructions on how to ask for a reconsideration of a decision. 2. The Commission has provided the Curriculum Vitaes for all experts giving evidence to the Commission upon request. However, Commission staff Curriculum Vitae or Resumes are considered personal information and are protected under the Freedom of Information and Protection of Privacy Act. In particular, Section 22(1) of the Act requires that “The head of a public body must refuse to disclose personal information to an applicant if the disclosure would be an unreasonable invasion of a third party’s personal privacy” and 22(3) states that “a disclosure of personal information is presumed to be an unreasonable invasion of a third party’s privacy if…(d) the personal information relates to employment, occupational, or educational history”. …/2
2 LETTER NO. L-48-01 3. a) The Commission is not in possession of the EMF profiles requested. However, the Commission has requested UNC to provide electric and magnetic field profiles at the edge of the right-of-way and at the nearest residences and to compare those levels with existing levels when they file the final proposed route alignment. b) Line data will be available when UNC finalizes and files the final route alignment. c) The 230 kV line is required to strengthen the UNC grid for reliability purposes.
