Hall, Commissioner N.F. Nicholls, Commissioner ) O R D E R WHEREAS: A. By letter dated October 4, 2001, West Kootenay Power Ltd. (“WKP”) filed for Commission approval a Power Purchase Agreement (“the Agreement”) with Aquila Power Corporation (“Aquila”) for the purchase of 6x16 blocks of firm energy for November 2001 of 50 MW, December 2001 of 100 MW, January 2002 of 100 MW and February 2002 of 50 MW. The firm energy is purchased at the Mid Columbia Bus (Mid-C) and Bonneville Power Administration facilities between Mid-C and the U.S. border and is wheeled over Cominco Ltd.’s U.S. interconnection between Waneta and Boundary; and B. WKP states that the firm energy is required to meet its November 2001 through February 2002 load requirements; and C. On October 22, 2001, WKP changed its name to UtiliCorp Networks Canada (British Columbia) Ltd. (“UNC”); and D. The Commission has reviewed the filing and is satisfied that acceptance of the Agreement is necessary and in the public interest. NOW THEREFORE pursuant to Section 71 of the Utilities Commission Act and the Rules respecting Energy Supply Contracts, the Commission accepts the September 5, 2001 Power Purchase Agreement between WKP/UNC and Aquila for the purchase of firm energy for the months of November 2001 through February 2002.
