Pursuant to Section 88(3) of the Utilities Commission Act (“the Act”) the Commission, by Order No. G-77-98, approved for Novagas Canada Ltd. (“NCL”) an exemption from Part 3 of the Act other than Sections 24 and 25, for the West Stoddart facilities identified in Appendix I of the Order, which Novagas used to transport or process natural gas for others, effective August 28, 1998; and B. On March 6, 2001, TransCanada Midstream advised the Commission that NCL sold the West Stoddart gas processing plant and associated pipelines to Williams Energy Canada Inc. (“Williams Energy”) in October 2000 and that Commission Order No. G-77-98 approving the exemption for NCL was no longer required. Williams Energys exemption for the West Stoddart facilities purchased from NCL was approved by Order-in-Council No. 16, 2001 and Commission Order No. G-13-01; and C. The Commission has reviewed the TransCanada request to rescind the Order approving the NCL exemption. NOW THEREFORE pursuant to Section 99 of the Act, the Commission rescinds Order No. G-77-98, effective April 5, 2001.
