Ostergaard, Chair ) P.G. Bradley, Commissioner ) January 9, 2001 N.F. Nicholls, Commissioner ) O R D E R WHEREAS: A. Commission Order No. C-11-98, dated June 30, 1998, approved a Certificate of Public Convenience and Necessity (“CPCN”) for Sun Peaks Utilities Co., Ltd. (“SPUCL”) to construct and operate an underground propane grid system at the Sun Peaks Resort Community near Kamloops, B.C.; and B. Commission Order No. C-11-98 required SPUCL to file its Gas Tariff, General Terms and Conditions and Rates for Gas Service for approval; and C. On July 17, 2000, SPUCL applied to the Commission for approval of its Gas Tariff, General Terms and Conditions and Rates for Gas Service, effective from the date of inception on March 1, 1997; and D. SPUCL sent a newsletter to its customers informing them of the Application before the Commission; and E. The proposed Gas Tariff outlines the fees, charges and terms under which SPUCL would provide service to its customers; and F. The Commission has reviewed the filing and finds that approval is in the public interest. NOW THEREFORE pursuant to Sections 59, 60 and 61 of the Utilities Commission Act, the Commission orders as follows: 1. The Gas Tariff, General Terms and Conditions and Rates for Gas Service for SPUCL is approved as permanent, effective March 1, 1997. 2. Within 60 days of the issue of this Order, on complaint by an interested party, the Commission may direct an inquiry into the new schedule of rates. 3. SPUCL is to inform all affected customers of the Order by way of a customer notice. DATED at the City of Vancouver, in the Province of British Columbia, this twenty-fourth day of January 2001.
