Commission Order No. G-134-99 approved the November 22, 1999 Settlement Agreement setting up an amended rate adjustment mechanism (“the Incentive Mechanism”) for the period beginning January 1, 2000 and ending December 31, 2002, whereby West Kootenay Power Ltd., (now UtiliCorp Networks Canada (British Columbia) Ltd., UtiliCorp”) is required to file annually with the Commission materials for a rate change, if any, effective January 1 of the next year; and B. The terms of the Settlement Agreement require that an Annual Review process be instituted, whereby the public will be invited to examine the filed material, submit other issues for determination by the Commission, and meet to review all issues prior to the final rate application being made. Following the review, unsatisfied parties may initiate a complaint with the Commission; and C. UtiliCorp has committed to file its Preliminary 2002 Revenue Requirements and Incentive Mechanism Review Application (“the Application”) by November 9, 2001; and D. A 2001 Annual Review is required to assess UtiliCorps performance and to make adjustments against the 2000 and 2001 Revenue Requirements. NOW THEREFORE the Commission orders as follows: 1. The Commission will hold a 2001 Annual Review on December 5, 2001 commencing at 8:30 a.m. at the Coast Capri Hotel, 1171 Harvey Avenue, Kelowna, B.C. A Public Information Town Hall Meeting will commence at 7:00 p.m. on December 5, 2001 for those parties not wishing, or able, to participate in the 2001 Annual Review. 2. UtiliCorp will arrange for publication of the attached Notice of Annual Review, as soon as possible but no later than November 12, 2001, in such appropriate local news publications in its service area so as to provide adequate notice to the public. 3. UtiliCorp is to provide copies of its Application and this Order to all parties who registered in the 2000 Annual Review and the Negotiated Settlement Process. . . ./2

UtiliCorp is to provide copies of this Order, with an appropriate notice, to all of its wholesale and large industrial customers. 5. Participants requesting additional information from UtiliCorp should do so as soon as possible. After receipt of the material, UtiliCorp is directed to use its best efforts to respond in a timely manner to information requests. 8. Intervenors intending to apply for Participant Assistance must do so consistent with the Commission's Participant Assistance/Cost Award Guidelines. (now UtiliCorp Networks Canada (British Columbia) Ltd., UtiliCorp”), and interested parties. UtiliCorp will be filing its Preliminary 2002 Revenue Requirements and Incentive Mechanism Review Application with the Commission by November 9, 2001. The public is invited to examine the material, submit other issues for determination by the Commission, and meet to review all issues at an Annual Review Meeting. The Commission will hold the 2001 Annual Review of UtiliCorps Application on Wednesday, December 5, 2001, commencing at 8:30 a.m., in the Coast Capri Hotel, 1171 Harvey Avenue, Kelowna, B.C. A Public Information Town Hall Meeting will be held at 7:00 p.m. on Wednesday, December 5, 2001 in the same location for those parties not wishing, or able, to participate in the Annual Review. UtiliCorp representatives will attend both meetings to answer questions from customers and interested parties.
