Ostergaard, Chair K.L. Hall, Commissioner N.F. Nicholls, Commissioner CERTIFICATE OF PUBLIC CONVENIENCE AND NECESSITY WHEREAS: A. On October 17, 2002, BC Gas Utility Ltd. (“BC Gas”) applied to the Commission for approval to further extend by one year the 21-year Gas Franchise Agreement between Inland Natural Gas Co. Ltd. (a predecessor company to BC Gas) and the City of Prince George (“the City”) approved by Order No. G-39-80, which was extended by one year to October 31, 2001 by Order No. C-7-00, and a further one-year to October 31, 2002 by Order No. C-14-01; and B. BC Gas and the City have both agreed to further extend the expiry date of the Gas Franchise Agreement from October 31, 2002 to October 31, 2003; and C. The Commission has reviewed the application and finds that a further extension to the expiry date of the Gas Franchise Agreement is in the public interest. NOW THEREFORE the Commission, pursuant to Section 45(7) of the Utilities Commission Act, approves for BC Gas a further one-year extension to October 31, 2003 of the Gas Franchise Agreement with the City of Prince George.
