The Commission, by Order No. P-3-98, approved the methodology for calculating the revenue requirement for Trans Mountain Enterprises of British Columbia Limited (“TME”) for the years 1998 to 2002 inclusive, subject to review in the event of a complaint; and B. By Order No. P-3-98 the current tolls were set as interim effective January 1, 2002 pending an application for permanent 2002 tolls; and C. On April 25, 2002, TME filed an application to set final tolls, effective May 1, 2002, in accordance with the 1998 to 2002 Incentive Agreement and Commission Order No. P-3-98; and D. TME confirmed that a draft copy of the application was circulated to its Shippers on March 6, 2002, which was reviewed at a Shippers’ meeting on March 21, 2002. A revised final application was provided to Shippers on April 17, 2002. In an April 24, 2002 letter, Bull, Housser & Tupper, Solicitors representing the Shippers consisting of the Vancouver Airport Airline Fuel Committee and the Vancouver Airport Fuel Facility Corporation, advised that there were no objections to the final application, although they urged TME to achieve economies in its pipeline operation to reduce costs; and E. The Commission has reviewed the application and finds that approval of the 2002 tolls for the jet fuel pipeline is required. .../2
2 NOW THEREFORE the Commission orders as follows: 1. The Commission approves for TME the 2002 tolls on its jet fuel pipeline, pursuant to Section 44 of the Pipeline Act, that allows for an increase of approximately 2.15 percent, effective May 1, 2002, subject to review in the event of a complaint. 2. The Commission confirms the current interim tolls as permanent from January 1, 2002 to April 30, 2002. 3. The Commission approves for TME housekeeping changes to its updated Rules and Regulations, effective May 1, 2002, as filed in its April 25, 2002 application. 4. TME is to provide all Shippers on the jet fuel pipeline with a copy of this Order, the approved Turbine Fuel Tariff No. 24 and the updated Rules and Regulations.
