Ostergaard, Chair ) N.F. Nicholls, Commissioner ) August 22, 2002 O R D E R WHEREAS: A. The Commission, by Order No. C-4-00, approved a Certificate of Public Convenience and Necessity for Stargas Utilities Ltd. (“Stargas”, “Company”) to operate a natural gas distribution system at the resort community of Silver Star; and B. The Commission, by Order No. G-116-00, approved the Stargas Standard Fees and Charges Schedule and the Administrative Charges Schedule, effective October 1, 1999. The Order also approved the creation and maintenance of an interest-bearing deferral account to accumulate the amortization related to the Stargas capital assets; and C. Stating that it has incurred losses in each of its three fiscal years, on August 15, 2002 Stargas filed an Application to re-capitalize the Company, revise the ownership structure, and increase rates and fees; and D. The Commission finds that a Regulatory Agenda for a written public hearing is required to be established. NOW THEREFORE pursuant to Sections 54, 58, 60 and 61 of the Utilities Commission Act, the Commission orders as follows: 1. Stargas is to inform all customers of this Order by way of a customer notice. 2. Stargas shall provide a copy of this Order, by facsimile if possible, to all previous Intervenors and Interested Parties no later than Friday, September 6, 2002. Stargas shall also post a copy of this Order in various Resort centres and give notice through other community resources, in order to adequately notify its customers. . . ./2

Intervenors and Interested Parties should inform the Commission, in writing, by Friday, September 20, 2002, of their intention to actively intervene in the proceeding, or become Interested Parties. Registered Intervenors will receive from Stargas copies of the Application, all correspondence and filed documentation. Interested Parties will receive copies of all Orders issued. 4. Copies of information requests from Intervenors about issues concerning the Application, should be filed with the Commission and Stargas by Friday, September 27, 2002. 5. Stargas shall respond to all information requests no later than Friday, October 11, 2002. 6. Intervenors may submit written submissions on the Application to the Commission and to Stargas by Friday, October 18, 2002. 7. Stargas shall reply to the written submissions of Intervenors by Friday, October 25, 2002, after which time the Commission will make its determinations.
