Ostergaard, Chair R.D. Deane, Commissioner O R D E R WHEREAS: A. On January 21, 2003, BC Gas Utility Ltd. (“BC Gas”) requested Commission approval of revised arrangements for the supply of gas to its Fort Nelson Division for the 2002/03 gas contract year; and B. The gas supply arrangements for Fort Nelson include the use of 300 TJ of BC Gas’ Aitken Creek Storage by Fort Nelson and for the purchase of up to 2,000 GJ per day set out in revisions to the May 1, 1999 Gas Supply Contract No. GS-2035.028 with EnCana Gas Marketing (“EnCana”); and C. The Commission has reviewed the BC Gas filing and is satisfied that the revisions to the gas supply arrangements for the Fort Nelson Division are in the public interest. NOW THEREFORE pursuant to Section 71 of the Utilities Commission Act and the Rules respecting Energy Supply Contracts, the Commission orders as follows: 1. The Commission accepts for filing for BC Gas the revisions to the May 1, 1999 Gas Supply Contract No. GS-2035.028 with EnCana, regarding prices and terms for the delivery of 2,000 GJ per day to Fort Nelson for the 2002/03 gas contract year, as set out in BC Gas’ January 21, 2003 Application. 2. The Commission accepts BC Gas’ use of 300 TJ of Aitken Creek Storage by the Fort Nelson Division. 3. The Commission accepts BC Gas’ request to maintain the contract documents as confidential.
