Ostergaard, Chair P.G. Bradley, Commissioner R.D. Deane, Commissioner N.F. Nicholls, Commissioner ) O R D E R WHEREAS: A. The Commission, by Order No. G-25-00, approved for British Columbia Hydro and Power Authority (“B.C. Hydro”) a December 31, 1999 Power Sale Agreement as Electric Tariff Supplement No. 1 with the City of New Westminster (“the City”) for the supply of power effective January 1, 2000 to December 31, 2002, or until such time as the Commission had completed a Rate Design Review, whichever came first; and B. On November 26, 2002, B.C. Hydro filed for Commission approval a November 22, 2002 Extension and Amending Agreement with the City extending the December 31, 1999 Power Sale Agreement for a further six months to June 30, 2003, to allow for B.C. Hydro and the City to agree on a new Power Sale Agreement that would be retroactive to January 1, 2003; and C. In a letter dated November 22, 2002 the City agreed with the proposed six month extension to the December 31, 2002 Power Sale Agreement; and D. The Commission has reviewed the Extension and Amending Agreement between B.C. Hydro and the City and finds that approval is required. NOW THEREFORE the Commission approves for B.C. Hydro the November 22, 2002 Extension and Amending Agreement with the City of New Westminster that extends the December 31, 1999 Power Sale Agreement by six months to June 30, 2003.
