Ostergaard, Chair P.G. Bradley, Commissioner N.F. Nicholls, Commissioner O R D E R WHEREAS: A. On July 19, 2002, BC Gas Utility Ltd. (“BC Gas”) filed for Commission approval a Further Amended and Restated Bypass Transportation Agreement (“the Agreement”) with Dunkley Lumber Limited (“Dunkley”) dated June 1, 2002. The Agreement replaces the current Bypass Transportation Agreement that is filed as Rate Schedule 25 Tariff Supplement No. E-2, which will expire on November 1, 2002; and B. The Agreement has a term of ten years, covering the period November 1, 2002 to November 1, 2012. The term of the Agreement may be extended by Dunkley by providing written notice to BC Gas 12 months before the termination date of the Agreement; and C. The Agreement recognizes Dunkley’s increased daily and annual consumption volumes and provides for a rate increase for the cost of new facilities that are needed to deliver the increased volumes; and D. The Commission has reviewed the Agreement and finds that it should be approved. NOW THEREFORE the Commission approves the Agreement between BC Gas and Dunkley, as a Rate Schedule 25 Tariff Supplement, for a ten-year term commencing November 1, 2002.
