Certificate of Public Convenience and Necessity No. C-15-02 Extension of Natural Gas Distribution System to Sooke, B.C. __________Removal of Conditions in CPCN No. C-15-02_______ This letter is in response to Centra Gas’ Application dated January 28, 2003 requesting that the Commission remove the condition in CPCN No. C-15-02 that requires that Centra Gas have “the right to use the Galloping Goose right-of-way for the Pipeline over the long term under reasonable terms and conditions and usage fees”. The January 28, 2003 Letter Agreement with the B.C. Transportation Financing Authority indicates significant progress has been made in the negotiation of a satisfactory Natural Gas Pipeline Corridor Licence (the “Licence”) for the use of the Galloping Goose Regional Trail right-of-way. However, the Commission considers that the Licence needs to provide Centra Gas with a clear option to renew the Licence (rather than the right to “seek to renew”). Also, the Commission notes that the fee for the renewal period will require Commission approval at that time in order for the fee to be recovered in customer rates. The Commission is prepared to remove the condition in CPCN No. C-15-02 providing a Licence with satisfactory terms based on the January 28, 2003 Letter Agreement and the foregoing comments is filed by February 28, 2003.
