Ostergaard, Chair ) K.L. Hall Commissioner ) May 16, 2003 R.H. Hobbs, Commissioner ) O R D E R WHEREAS: A. On May 7, 2003, Terasen Gas Inc. (“Terasen Gas”) applied to the Commission for approval of a Pipeline Agreement with Esso Resources Canada Limited (“Esso”) dated December 15, 1985 as a Tariff Supplement effective November 1, 1993 and the cancellation of the Agreement and Tariff Supplement effective January 1, 2003; and B. The Application also requested approval of an Amended and Restated Pipeline Agreement with Fording Coal Ltd. dated September 1, 2002 as a Tariff Supplement effective January 1, 2003; and C. The Commission has reviewed the Application and finds that the Application should be approved. NOW THEREFORE the Commission orders as follows: 1. The Commission approves for Terasen Gas the December 15, 1985 Pipeline Agreement with Esso as a Terasen Gas Tariff Supplement effective for the period November 1, 1993 to January 1, 2003, and the cancellation of the Tariff Supplement effective January 1, 2003. 2. The Commission approves for Terasen Gas the Amended and Restated Pipeline Agreement with Fording Coal Ltd. as a Terasen Gas Tariff Supplement effective January 1, 2003. 3. The Commission will accept, subject to timely filing by Terasen Gas, the Agreements in approved Tariff Supplement format.
