V6E 3G2 Dear Mr. Johnson: Re: Insurance Corporation of British Columbia (“ICBC”) 2004 Revenue Requirements Application for Universal Compulsory Automobile Insurance Information Request of Mr. Russell Sykes The Commission Panel has reviewed your letter of September 29, 2003, which states that ICBC does not intend to respond to the information request of Mr. Sykes. ICBC identifies that the information request is late, contains 537 questions and, given the vast amount of time required to respond to the information request, it would jeopardize the written hearing schedule determined by the Commission in Order No. G-54-03. Commission staff have had an opportunity to discuss your letter with Mr. Sykes. While he believes the questions are relevant to a full review of ICBC’s financial situation, he is also aware of the tight timetable before the Commission in this year’s limited written hearing and that the application by ICBC is related to two expected cost categories. The Commission Panel has some sympathy for the position of Mr. Sykes, but as has been articulated in the Commission’s letter of September 26, 2003, this year’s review is constrained by the time available to issue a Decision on the 2004 compulsory automobile insurance rates. For that reason, the Commission established the written hearing process to review the abbreviated application from ICBC. The Commission therefore determines that it cannot delay this year’s proceeding to allow for the responses to this late information request. L-48-03 2 However, Mr. Sykes has undertaken an in-depth review of the ICBC application and many of the questions in his information request may be useful to all participants in next year’s expanded public hearing process.
