V7H 1C4 Dear Mr. Sykes: Re: Insurance Corporation of British Columbia (“ICBC”) This letter responds to your correspondence of December 31, 2003, January 5, 2004 and January 11, 2004. Your correspondence of December 31, 2003 provides advice to the Commission with respect to ICBCs 2004 public hearing process. The Commission dealt with that subject matter in Commission Letter No. L-2-04 dated January 9, 2004. You were copied on that correspondence. Your letter of January 5, 2004 takes issue with correspondence from ICBC dated September 29, 2003 with respect to the late Information Request which you filed pursuant to the review of ICBCs 2004 Revenue Requirements Application. In Commission Letter No. L-48-03 the Commission determined that it could not delay the proceeding to allow for responses to your late Information Request. The Commission granted ICBCs request that it not be required to respond to the Information Request. The Commission also disseminated your Information Request on the basis that it may be helpful to all participants in the 2004 expanded public hearing process. The Commission Panel did not take account of ICBCs letter of September 29, 2003 or your Information Request in its deliberations to set the 2004 Revenue Requirements. The Commission does not see any value in requiring proof of Mr. Johnsons assertions or a requirement that ICBC disclose the total amount of his billings, at this time. Your correspondence of January 11, 2004 has to do with ICBCs Application for Leave to Appeal a portion of Commission Order No. G-75-03 and its companion Decision. The Commission anticipates that ICBC will pursue a Reconsideration Application to the Commission prior to advancing its Leave to Appeal Application. If the Leave to Appeal Application proceeds, the Commission is normally restrained to providing information to the Court of Appeal with respect to factual or jurisdictional matters.
