Kelsey, Commissioner ) K.L. Hall, Commissioner ) May 14, 2004 O R D E R WHEREAS: A. The Commission, by Order No. G-59-00, approved for Aquila Networks Canada (British Columbia) Ltd. (“Aquila”) (formerly known as West Kootenay Power Ltd.) and British Columbia Hydro and Power Authority (“B.C. Hydro”) a Letter Agreement between Aquila and B.C. Hydro for Wholesale Transmission Service (“WTS”) from Aquila’s South Slocan Generating Station to its Princeton, B.C. substation during off-peak hours during the period from May 20 to July 31, 2000; and B. The Agreement provided for a renewal of the wheeling agreement terms between April 1 to July 31, 2001; and C. On June 19, 2002, Aquila applied to the Commission for approval of a June 17, 2002 Letter Agreement with B.C. Hydro to extend the WTS Agreement from South Slocan to Princeton for the off-peak hours for the period June 19, 2002 to July 31, 2002; and D. On June 20, 2002, by Order No. G-45-02, the Commission approved the extension of the term of the Letter Agreement for the off-peak hours for the period June 19, 2002 to July 31, 2002; and E. On May 20, 2003, by Order No. G-37-03 the Commission approved a further extension for the period May 20, to July 31, 2003; and F. On May 1, 2004, Aquila applied for a further extension for the Letter Agreement for the period May 1, 2004, to July 31, 2004; and G. On April 28, 2004, by letter to Aquila, B.C. Hydro agreed to the extension; and H. The Commission has reviewed the May 1, 2004 Application and finds that it should be approved. . . ./2
2 NOW THEREFORE the Commission approves for Aquila and B.C. Hydro an extension to the May 16, 2000 WTS Agreement for the transmission of power from Aquila’s South Slocan Generating Station to Aquila’s Princeton substation during off-peak hours for the period May 1, 2004, to July 31, 2004.
