Application to Acquire a Reviewable Interest in
Aquila Networks Canada (British Columbia) Ltd.
This letter responds to your recent undated letter that was received by the Commission on March 2, 2004,
forwarded by the Commission to counsel for the Applicant on that date. In your letter, you have requested an
extension to the deadline for submitting information requests and have suggested that an extension of at least four
weeks would be appropriate. The Commission has also considered the comments of counsel for the Applicants
which were received today.
In deciding on the process to consider this Application, the Commission noted the nature and extent of the
stakeholder consultation process undertaken by Aquila/Fortis. The Commission noted the generally positive
response from stakeholders to the proposed sale but considered that in order to ensure as broad a notice as
possible of the proposed sale and the Application before the Commission, the Applicant should be directed to
publish a notice in local papers. The Commission established a written process to consider the Application and
set deadlines for that process which were outlined in the public notice. In addition, copies of the Application were
made available in public facilities in main service areas including Oliver, B.C.
As a result of the public notice, a number of Intervenors and Interested parties have registered with the
Commission by the established deadline. The Commission is satisfied that as a result of the recent public notice
and the efforts of Aquila/Fortis since November, 2003, adequate and reasonable efforts have been made to advise
stakeholders of the proposed sale and the opportunity to obtain more information.

On the issue of a time extension for the preparation of Information Requests which were due on March 2, 2004,
the Commission notes that with the exception of one request made on your behalf for an extension, the
Commission has received no other similar requests. Nor has any other party filed information requests.
Nevertheless, to allow you an opportunity to prepare further Information Requests on your behalf, the
Commission will extend the deadline for submission of information requests to March 9, 2004. The Commission
will extend the subsequent steps in the process to accommodate this change and will extend the period for
Intervenor Written Comments to March 22, 2004. The revised timetable is set out below:
