[formerly known as Aquila Networks Canada (British Columbia) Ltd.] for Approval of a Bypass Rate Agreement BEFORE: L.F. Kelsey, Commissioner K.L. Hall, Commissioner O R D E R WHEREAS: A. On May 5, 2001, the Commission received an Application from Aquila Networks Canada (British Columbia) Ltd. (“Aquila”) for approval of a Bypass Rate Agreement (the Agreement”) with Pope and Talbot Ltd. (“Pope and Talbot”); and B. The Agreement between Aquila and Pope and Talbot is to be effective May 31, 2003 and extend for a period of 20 years; and C. Pursuant to the Agreement, Pope and Talbot will be transferred to Aquila Rate Schedule 31 which normally applies at transmission voltage, and will pay a monthly Bypass Rate Rider of $3,847.00 per month, subject to a consumer price escalation clause; and D. Information provided by Aquila and Pope and Talbot indicates that the Bypass Rate is based upon a reasonable estimate of the cost of bypass for Pope and Talbot; and E. On June 1, 2004, Aquila changed its name to FortisBC Inc.; and F. The Commission has reviewed the application and finds that it should be approved. NOW THEREFORE the Commission approves for FortisBC Inc., effective May 31, 2003, its May 5, 2004 Bypass Rate Agreement with Pope and Talbot as Tariff Supplement No. 8.
