BEFORE: L.F. Kelsey, Commissioner K.L. Hall, Commissioner O R D E R WHEREAS: A. On February 17, 2004 the Commission received an application from Pengrowth Corporation for an exemption from Section 71 and Part 3 of the Utilities Commission Act (“the Act”) for the purposes of the sale of power to L&E Consulting Ltd.; and B. Pengrowth Corporation owns and operates a diesel generator in an isolated area of North Eastern BC (LSD B-38-J/94-H-2) for the purposes of supplying power to its oil field operations; and C. L&E Consulting Ltd. owns and operates a camp for oil field workers near the same area; and D. Pengrowth Corporation and L&E Consulting Ltd. have entered a mutually acceptable agreement for the sale and delivery of power from Pengrowths diesel generation; and E. Pursuant to Section 88(3) of the Act the Commission has requested and received approval from the Lieutenant Governor in Council by Order in Council No. 687, 2004 (attached as Appendix A to this Order) to issue an exemption from Section 71 and Part 3 (except Section 22) of the Act; and F. The Commission, pursuant to Section 99 of the Act, may reconsider, vary or rescind a decision, order, rule or regulation made by it. 2 NOW THEREFORE the Commission orders that Pengrowth Corporation is exempt from Section 71 and Part 3 (except Section 22) of the Utilities Commission Act for the sale and delivery of power to L&E Consulting Ltd. for use in its camp at area LSD -21-K/94-H-2.
