Hobbs, Chair ) June 25, 2004 O R D E R WHEREAS: A. On May 31, 2004, the British Columbia Transmission Corporation (“BCTC”) filed, pursuant to Sections 45(6) and 45(6.1) of the Utilities Commission Act, an Application for approval of a Transmission System Capital Plan (“the Application”); and B. BCTC submitted evidence on its capital plan in the British Columbia Hydro and Power Authority (“BC Hydro”) 2004-05 and 2005-06 Revenue Requirements Application, filed on December 15, 2003, and testified to the plan in that proceeding. BCTC has stated that the Application will not materially change the revenue requirements of BC Hydro during the test period; and C. As part of the BCTC Capital Plan filing, BCTC has provided a reconciliation with the BC Hydro revenue requirements application; and E. The Commission concludes that a written regulatory process should be established to deal with the Application. NOW THEREFORE the Commission orders as follows: 1. A written public hearing is established for the review of the Application. 2. BCTC will publish, as soon as possible in display ad format; the Notice of the Written Public Hearing attached as Appendix A to this Order, in such appropriate news publications as may properly provide adequate notice to the public. 3. The Application and supporting material will be made available for inspection at the Head Office of BCTC at Suite 1100, Four Bentall Centre, 1055 Dunsmuir Street, Vancouver, B.C. and at the British Columbia Utilities Commission, Sixth Floor, 900 Howe Street, Vancouver, B.C. …/2

Registered Intervenors and Interested Parties should inform the Commission in writing, by Friday, July 16, 2004 of their intention to intervene and identify the nature of their interest in the Application. 5. The following Regulatory Agenda is established for the written public hearing: (a) Written information requests will be submitted to BCTC by Friday, July 23, 2004; (b) Written responses to information requests will be completed by BCTC by Friday, August 6, 2004; (c) Written submissions and comments may be made to the Commission with a copy to BCTC by Friday, August 20, 2004; and (d) BCTC may submit to the Commission a Final Response to those submissions by Friday, September 3, 2004. The approvals requested by BCTC include confirmation that expenditures for certain projects contained in the plan are in the public interest. THE REGULATORY PROCESS The Commission will review the Capital Plan Application using a Written Public Hearing process according to the following Regulatory Schedule: 1. Registered Intervenors and Interested Parties may register by Friday, July 16, 2004; 2. Written information requests will be submitted to BCTC by Friday, July 23, 2004; 3. Written responses to information requests will be completed by BCTC by Friday, August 6, 2004; 4. Written submissions and comments may be made to the Commission with a copy to BCTC by Friday, August 20, 2004; and 5. BCTC may submit to the Commission a Final Response to those Submissions by Friday, September 3, 2004. A decision by the Commission will follow. Persons not expecting to actively participate, but who have an interest in the Capital Plan Application, should register as Interested Parties with the Commission, in writing, by the same date and identify their interest in the matter.
