Kelsey, Commissioner November 3, 2005 O R D E R WHEREAS: A. October 27, 2005 Columbia Energy Inc. (“Columbia Energy”) applied to the Commission for a Gas Marketer Licence for the 2005/06 Gas Contract year. The application included the payment of the $1,000 application fee and a $250,000 Letter of Credit pursuant to the requirements of Item 3 of the Licence application form; and B. The Commission has reviewed Columbia Energy’s application and relying upon the information and representations made by Columbia, finds that approval of the Gas Marketer Licence subject to conditions is warranted. NOW THEREFORE pursuant to Section 71.1(6) of the Utilities Commission Act, the Commission orders as follows: 1. The Commission issues to Columbia Energy a Gas Marketer Licence for the period November 1, 2005 to October 31, 2006. 2. The Licence is subject to the following conditions: 2.1 Columbia Energy will carry out the undertakings as set out in the application for a Licence to Market Natural Gas dated October 27, 2005 and the Rules for Gas Marketers. 2.2 Columbia Energy will comply with the Code of Conduct for Gas Marketers and Rate Schedule 36 of Treason Gas Inc. . . ./2
2 2.3 Columbia Energy will maintain a Letter of Credit or acceptable substitute in full force and effect for the duration of the Licence. 2.4 Columbia Energy will maintain a Working Capital position of at least $50,000 and a Current Ratio of current assets to current liabilities of at least 1.10. 2.5 The Commission may, at any time and without prior notice to Columbia Energy, withdraw the Gas Marketer Licence for reasons the Commission, in its sole discretion, deems and considers sufficient. 2.6 The Gas Marketer Licence and all copies of it shall remain the property of the Commission and Columbia Energy will return these documents forthwith upon written request from the Commission. Kelsey, Commissioner L.A. Boychuk, Commissioner O R D E R WHEREAS: A. On June 22, 2005, Letter No. L-43-05 accepted the 2005/06 Pacific Northern Gas Ltd. (“PNG”) Annual Gas Contracting Plan; and B. On November 15, 2005 PNG filed with the Commission gas contracts for approval of the monthly and daily price premiums for gas supply arrangements that include seasonal, peaking, and storage contracts; and C. The Commission has reviewed the PNG filing and is satisfied that the gas supply contracts are appropriate considering market prices at the time they were negotiated and that they are consistent with the Annual Contracting Plan for 2005/2006. NOW THEREFORE pursuant to Section 71 of the Utilities Commission Act and the Commission’s Energy Supply Contract - Rules, the Commission accepts for filing the natural gas contracts shown in Appendix A.
