Kelsey, Commissioner November 24, 2005 L.A. Boychuk, Commissioner O R D E R WHEREAS: A. On April 5, 2001, Synex Energy Resources Ltd. (“SERL”) applied to the Commission for a Certificate of Public Convenience and Necessity (“CPCN”) to provide electricity to Fair Harbour, Chamiss Bay and Kyuquot by means of a 14.4kV single phase connection to the provincial electricity grid; and B. On November 15, 2001, the Commission approved by Order No. C-18-01, a CPCN for SERL to construct and operate a 14.4kV single phase distribution line from B.C. Hydro’s grid at Oclucje to Kyuquot subject to construction of the distribution line starting within two years of the date of the Order; and C. The approval in Order No. C-18-01was also conditional on SERL or a company formed for the purposes of being a public utility: • maintaining separate accounts and filing annual reports which summarize the results of the utility operations; • filing for Commission approval, proposed rates and terms and conditions of service upon completion of the construction; • providing a copy of the CPCN Order to each new customer and maintaining a copy of the approved Rate Schedules and Terms and Conditions of Service to be available for inspection by customers; and D. In accordance with Order No. C-18-01, SERL founded a wholly-owned subsidiary, Kyuquot Power Ltd. (“KPL”), a public utility for the purpose of operating the distribution line; and E. On September 14, 2005, KPL applied to the Commission for approval of an Electric Tariff containing terms and conditions of service and rate schedules, pursuant to Section 60 of the Utilities Commission Act (“the Application”); and F. The Commission requires that interim rates and a regulatory process to deal with the Application be established. . . ./2
2 NOW THEREFORE the Commission orders as follows: 1. The Application will be examined in a written public hearing process and the Regulatory Agenda attached as Appendix A, has been established. 2. The Commission pursuant to Sections 60 and 89 of the Act, approves the Electric Tariff on an interim basis for all classes of customers effective November 15, 2005, subject to refund with interest at the average prime rate of KPL’s principal bank. 3. KPL will publish no later than Thursday, December 8, 2005 in a display-ad format a public notification attached as Appendix B to potential customers at the local school and in the local newspaper, so as to provide adequate notice to the customers in the service area of the utility. 4. The Application and supporting material will be made available for inspection at the Head Office of KPL, Fourth Floor, 1444 Alberni Street, Vancouver, B.C., the British Columbia Utilities Commission, Sixth Floor, 900 Howe Street, Vancouver, B.C. and at the local school of the service aera. 5. Intervenors and Interested Parties should inform the Commission, in writing or register on-line via the Commission’s website at www.bcuc.com, by Tuesday, December 20, 2005 of their intention to intervene. THE APPLICATION On September 14, 2005, KPL applied to the British Columbia Utilities Commission (“the Commission”) for approval of its Electric Tariff (“the Application”) pursuant to Section 60 of the Utilities Commission Act. The Application contains the terms and conditions of service and rate schedules for Residential and Commercial Service and Municipal Street Lighting Service.
APPENDIX B to Order No. G-123-05 Page 2 of 2 THE REGULATORY PROCESS By Order No. G-123-05, the Commission approved the Application on an interim basis effective November 15, 2005. The differences between the interim and permanent rates are refundable with interest. The Commission has established a Written Hearing Process to review the Application.
