Hobbs, Chair May 25, 2005 O R D E R WHEREAS: A. Pursuant to Section 71 of the Utilities Commission Act (the “Act”) on April 29, 2005 British Columbia Hydro and Power Authority (“BC Hydro”) filed with the Commission certain agreements (the “Amending Agreements”) that amend Electricity Purchase Agreements that it has entered into (the “Application”). The Amending Agreements are listed in Appendix A to this Order and are more specifically identified in Schedule A (“Schedule A”) of BC Hydro’s April 29, 2005 letter; and B. In the Application, BC Hydro stated that all of the underlying Electricity Purchase Agreements have previously been accepted by the Commission as filed, pursuant to Section 71 of the Act; and C. In the Application, BC Hydro also stated that the amendments set out in the Amending Agreements are of a relatively minor nature and that, with this filing, it has filed all of the amendments to which it is a party, except those that are exempted from filing pursuant to an Order under Section 22 of the Act; and D One of the Amending Agreements is an Extension Agreement (the “Extension Agreement”) with Duke Point Power Limited Partnership (“Duke Point Power”) dated March 2, 2005 which amends the Electricity Purchase Agreement dated November 16, 2004 that was the subject of Commission Order No. E-1-05. The Extension Agreement also amends the Vancouver Island Generation Project Transfer Agreement dated November 16, 2004, which was not filed pursuant to Section 71 of the Act. The terms of the Extension Agreement were referred to in a letter from BC Hydro to the Commission dated March 3, 2005; and E. In the Application, BC Hydro requested that the Commission keep the Amending Agreements and Schedule A confidential; and F. The Commission has considered the Application. . . ./2
2 NOW THEREFORE the Commission orders as follows: 1. The Amending Agreements that are set out in Appendix A to this Order, except for the Extension Agreement, are accepted as filed as amendments to energy supply contracts, pursuant to Section 71 of the Act. 2. The Extension Agreement is accepted as filed with respect to the amendments that it makes to the Electricity Purchase Agreement with Duke Point Power, pursuant to Section 71 of the Act. 3. The Commission will keep confidential the Amending Agreements and Schedule A.
