Kelsey, Commissioner CERTIFICATE OF PUBLIC CONVENIENCE AND NECESSITY WHEREAS: A. On April 14, 2005, Terasen Gas Inc. (“Terasen Gas”) applied to the British Columbia Utilities Commission (“the Commission”) for approval of an extension to the Franchise Agreement (“the Application”) with the District of 100 Mile House (“the District”); and B. The Franchise Agreement expired June 30, 2001; and C. The Commission approved extensions to the Franchise Agreement by Order No. C-1-02 to June 30, 2002; by Order No. C-13-02 to June 30, 2003; by Order No. C-10-03 to June 30, 2004; and by Order No. C-11-04 to December 31, 2004; and D. The Application requests an extension of the Franchise Agreement until December 31, 2005; and E. Terasen Gas requests approval to continue the condition contained in the CPCN that Terasen Gas shall pay annually to the District, a franchise fee equivalent to 3 percent of the gross annual revenues of Terasen Gas derived from sales of natural gas within the area encompassed by the terms of the Operating Agreement; and F. The Commission has reviewed the Application and considers that approval is warranted. NOW THEREFORE the Commission, pursuant to Section 45 of the Utilities Commission Act, approves for Terasen Gas, the extension of the Franchise Agreement with the District of 100 Mile House, from December 31, 2004 to December 31, 2005.
