Kelsey, Commissioner CERTIFICATE OF PUBLIC CONVENIENCE AND NECESSITY WHEREAS: A. On June 23, 2005, Terasen Gas Inc. (“Terasen Gas”) applied to the British Columbia Utilities Commission (“the Commission”) for approval of an extension to the Operating Agreement (“the Application”) with the District of Hudson’s Hope (“the District”); and B. The Operating Agreement expired June 30, 2001; and C. The Commission approved extensions to the original Operating Agreement by Order No. C-11-01 to June 30, 2002; by Order No. C-13-03 to June 30, 2004; by Order No. C-12-05 to June 30, 2005; and D. The Application requests an extension of the Operating Agreement until June 30, 2006 or sixty days after the Commission’s approval of a new operating agreement between Terasen Gas and the District, whichever is earlier; and E. 2 F. The Commission has reviewed the Application and considers that approval is warranted. NOW THEREFORE the Commission, pursuant to Section 45 of the Utilities Commission Act, approves the extension of the Operating Agreement from July 1, 2005 to June 30, 2006 or sixty days after the Commission’s approval of a new Operating Agreement between Terasen Gas and the District of Hudson’s Hope, whichever is earlier.
